It is certainly _legal_ in that it doesn't violate US, state or local laws.
It may, however, be against EBay's rules - if they knew or cared about it.
EBay's main goal now, as a maturing company, is to keep shareholders happy - and analysts monitor statistics like number of listings, etc. So EBay really doesn't wanna cut back on sellers by rigorously enforcing their own rules.
