I understand, and he can claim that, but his claim would be BS in my opinion. The top bidder may have put in a high top bid and has not come back to check on the auction. Ebay will automatically increase the buyer's bid and let him know by email if he has been outbid. Even if the person came back to check on things, how would you catch that something changed in the auction? The main picture is the same and if you are bidding on multiple items you probably won't go into each item to read it again. You would typically just look at your list of items you are bidding on. You read the listing the first time before bidding and don't expect people to make radical changes to their listings later. You shouldn't have to watch people like a hawk to make sure you don't get screwed.
Keep in mind my little rant here isn't directed at you. I am upset with the seller for how this has been handled.

Ouch. this is almost painful to watch. Some buyer is going to be very sorely disappointed. Others may disagree, but I wouldn't pay the current bid amount for a new in box original 15C.
