I offered buyer full refund, but he refused and want only partial $$ back,,,,I'm more then glad to fully refund your $ matthias........

Spending hundreds of $$$ for an empty cardboard box on on hand, selling crap on the other hand... Ridiculous.

That's between you and Matthias .... if you need to talk to someone else try a counselor .. but leave us alone!

It looks like you are only interested in making more money, instead of correcting the deal you misrepresented.

Your obligation should be to the buyer, not the new buyer that will pay more money, for the box.

I think your intentions are what you are misrepresenting here.

You need to fix the old deal; not a new deal with someone else.

BTW, your offer of full refund should include all original shipping and insurance fees, along with the cost of shipping to return the item.

Keep the box; sell the calculator (disclosing the corrosion); move on.

Matthias is not happy with the transaction. If that is the case, it should be cancelled. He should get a full refund (including shipping and insurance because of the misrepresentation).

Matthias has not right to pick and choose what he keeps and how much he pays for it. All or nothing. Deal or no deal. That is the only fair way.

The seller's first obligation is to make it right with Matthias, for this misrepresentation.

His motives are not pure in this case. The seller would not be making this offer, if he didn't have a better offer from someone else. Remember, he didn't offer any refund (full or otherwise) initially. He was just going to leave Matthias hanging (see previous thread below).

Previous seller practice: This seller offered a partial refund in the past. On a previous transaction he said, "he said no just give me a partial refund..so i did and gave him $$ back". He also said about transactions in general, "i always refund $$ if customer isnt happy" So, it is his practice to offer partial refunds. ONLY, in this case, he refused any compromise or refund.

ONLY, after someone offered to buy the box for more than Matthias, did he decide he would offer a refund.

While Matthias does not have the right to pick and choose, he certainly does have the right to bring up this deception and request a partial refund. This is done all the time and is common practice.

And I wonder if the seller offered to refund all shipping, including the cost to return the item. Matthias shouldn't be out a penny.

It´s time to finish this scene for me:

1) I think, the seller doe not have another buyer. Neither the seller told me it´s name, nore the new buyer contacted me (as I desired).

2) There is another question concerning the new buyer: Why didin´t he bid on the item in the auction? This is the base on my thoughts that there is no new buyer.

3) Thanks a lot to all of you, expecially Mike. Let us keep this name in mind (as the seller does with mine)....

4) I will keep the whole item, will restore the calculator and sell it "AS A REPAIRED ITEM WITH PHOTOS OF THE BEFORE AND AFTER", as it should be. To the new buyer: You can still buy the calculator :)

5) I still think, I have a good chance to the seller with my fixing possibilities, but he never accepted them on time. So, bad luck for him.

6) By the way: Concerning the first auction I had with this seller: I demanded a refund on the HP-41 blanknut, cause the battery compartiments were corroded as well... As you can see, the seller does (only) sell rare items, so his words "I bought them on a garage store" are NOT true. You will never find these two rare items within 4 weeks in a garage store.

7) To Namir: I also think as you, this forum is mainly for technical questions, informations, ... but there is also a demand on overview of sellers and buyers: People want to know, which seller they can trust. What do you concern me? Giving a negative feedback? Then I alos would earn one. My feedbacks are all positive, the SELLER DOES HAVE 3 NEGATIVE FEEDBACKS, so this is his advantage.

Thanks for all input..But i'm done with this,,I'm willing to return every Penny he payed to me includeing shipping......But that all i can do.....No one can say i have to give back partial and he keeps it .Thats BULL....I cant go to a Local store buy a CB radio and go back tell him i want $300 back for the mic and i keep the unit it self..no where in the world business works like that......And to who said something about my english..I'm sorry next time i will write in my Language (german)...And yes matthias all these items came from Yard Sales and Swap meets.....I wish all of you best Luck in your Hobby.....And check my auctions out as i will continue to sell HP's when i find them, I guess from now on i will just have to take more and better pictures,,again sorry for any confusion, and if thats no enought please do not feel obligated to bid on my items......
